Who we are

Hyper Endurance Fitness is a global online coaching business delivering training, nutrition guidance and coaching through the Hyper Endurance Fitness App.

What your membership includes

Every membership gives you the same thing:

• A personalised training programme, built for you and adjusted as you progress
• Nutrition guidance aligned to your goals
• Progress tracking in the Hyper Endurance Fitness App
• Direct contact with your coach

There are no tiers of service. A member paying every four weeks receives exactly the same coaching as an annual member.

Coaching is a service, not a guaranteed outcome. Your results depend on your consistency, your effort and your circumstances. We do not promise specific results.

The three memberships and what you pay

Three memberships. Choose the one that suits how you want to commit.

How savings are calculated

Savings are measured against paying €54.99 every four weeks for the same length of time. A full year of four weekly payments is €714.87.

Prices

Membership prices are set in euro and include VAT where it applies. If you are buying from outside the eurozone, your bank or card provider may present and charge the amount in your local currency at their own exchange rate, and may add a conversion fee. The euro amount is the one that governs.

We may change prices, but a change never affects a term you have already paid for. See section 04.

Automatic renewal

Your membership renews automatically at the end of each term unless you cancel before your renewal date.

Advance notice

For the 6 month and annual memberships, we will email you at least 30 days before your renewal date, confirming when it renews and what you will pay.

If the price has changed

Your advance notice will state the new price. If you do not want to continue at that price, cancel before the renewal date. A price change never applies to a term you have already paid for.

Your membership is a commitment for its term

Once you agree and purchase a membership, whether that is 4 weeks, 6 months or annual, you are agreeing to the contract for that period of time. The term runs to its end. Cancelling does not cut short, or refund, a term you have already paid for. Your separate 14 day right of withdrawal is set out in section 05.

The 6 month and annual memberships

These memberships renew for a further term of the same length unless you give us 28 days notice before your renewal date. You can give that notice at any point during your term.

How to cancel, and the notice we need

Every membership needs 28 days notice to cancel, given before your renewal date. This applies to the 4 week, 6 month and annual memberships alike. Every membership is a commitment for its full term.

The 4 week membership renews every 28 days. Because renewals are 28 days apart, notice given part way through a 4 week term also covers the renewal after it, so your membership ends at the close of the following 4 week term.

Cancel through the App or by emailing us. We do not require a phone call or a form. We will confirm your cancellation in writing.

Cancelling stops your next renewal. Your access continues until the end of the term you have already paid for.

14 Day Right of Withdrawal

Where applicable under Irish and EU consumer law, you have a statutory 14 day right to withdraw from your online coaching membership.

Your Hyper Endurance Fitness membership and coaching services begin immediately upon purchase, at your express request.

If you exercise your statutory right of withdrawal during the 14 day withdrawal period, any refund will be calculated in accordance with applicable law and may take into account the proportionate value of the coaching and services supplied to you up to the date you notify us of your withdrawal.

This does not affect any statutory consumer rights that cannot legally be excluded.

How to cancel

Message your coach in the App and tell us you want to cancel. You can also email us, or use the cancellation form we send when you join. Put it in writing rather than raising it by phone, because if there is ever a dispute you will need to be able to show that you cancelled. We will confirm your cancellation in writing.

Refunds

Any refund due is returned to the payment method you used, within 14 days of the date you notify us of your withdrawal.

Cancelling after 14 days

After your first 14 days, you are committed to the term you have purchased. Cancelling stops your next renewal. It does not refund, or end early, the term you are currently in.

On every membership, give us 28 days notice before your renewal date. See section 04.

This does not affect your statutory rights. If we fail to deliver the coaching as described, for example if the service is significantly interrupted, you may be entitled to a remedy, a price reduction or a refund under consumer law, whatever this section says. Contact us first and we will put it right.

Illness and injury

Tell your coach as soon as something changes. Your coach adapts the programme around it, which is usually a better answer than stopping altogether and is a large part of what the coaching is for.

Memberships are not paused or extended for illness or injury. Your term runs as purchased.

Where a serious, longer term condition prevents you training for the remainder of a term, contact us and we will look at it individually. This does not affect your statutory rights.

Your health and your responsibility

You are responsible for making sure you are fit to train. If you have an existing condition or injury, or you are pregnant, get medical clearance before you start.

Tell us about relevant injuries, conditions and limitations, and keep us updated when they change. We build your programme on what you tell us.

Hyper Endurance Fitness provides coaching, programming and nutrition guidance. We do not provide medical advice, diagnosis or treatment. If something hurts, stop and see a doctor.

Nothing in these terms limits our liability for death or personal injury caused by our negligence. That liability cannot be excluded and we do not attempt to exclude it.

When we can end a membership

We may end a membership where a member materially breaches these terms. That means:

• Abusive or threatening behaviour towards your coach, anyone working with us, or other members
• Sharing App access, programming or materials with people who are not members
• Fraudulent payment activity

Where we end a membership for a serious breach of these terms, the remainder of the term is not refunded. This does not affect any refund you are entitled to by law.

Payments

Payments are processed by Stripe. Your card details are held by Stripe, not by us. We never see or store your full card number.

If a payment fails we will contact you before doing anything else. If it cannot be resolved, access may be suspended until it is.

Your data

We collect information about your health: injuries, conditions, measurements, and progress photographs where you provide them. Data protection law treats this as special category data and it receives additional protection.

We ask for your consent to this separately from your agreement to these terms, because the law requires the two to be separate. You can withdraw that consent at any time, though it will usually mean we can no longer coach you safely.

We will never publish your photographs, results or story without asking you separately and getting your permission in writing. That permission can be withdrawn at any time.

How we collect, use, share and keep your personal information, and your rights over it, is set out in our Privacy Notice.

Where we sell

We are based in the Republic of Ireland and these terms are governed by Irish law. If you are buying from outside Ireland, you may hold additional rights under the consumer law of the country you live in, and nothing here removes those rights.

Ownership of our website and content

This website and everything we create are owned by Hyper Endurance Fitness. That includes our programmes, workouts, meal plans, nutrition guidance, articles, videos, photographs, logos, the Hyper Endurance Fitness name and the design of this website, as well as the programmes and materials we deliver to you through the Hyper Endurance Fitness App.

Your membership gives you a personal right to use your programme and materials for your own coaching while your membership is active. It does not transfer ownership of any of our content to you.

You may not copy, share, resell, republish or reproduce any of our content, in whole or in part, without our written permission. Sharing our programming or materials with people who are not members is a breach of these terms, as set out in clause 9.

Your own photographs, measurements and personal information remain yours. Clause 11 explains how we look after them.

Changes to these terms

We may update these terms. We will tell you about material changes in advance, and they take effect from your next renewal, never in the middle of a term you have paid for.
